Terms & Conditions

Important: Please read these terms and conditions carefully.

All reservations made at Toowong Villas are made subject to these terms and conditions and the person making the reservation will be deemed to have accepted these terms and conditions on behalf of all persons who will be staying at Toowong Villas under the reservation (once the reservation is accepted and confirmed by Toowong Villas).

Guarantee Policy

Guarantee with a valid credit card is required at time of making a reservation via Toowong Villas website as well as on check-in to the Apartments. Although we endeavour to meet any requests we are unable to guarantee these and cannot be held responsible for requests not met.

Deposit Policy

Depending on the rate booked a deposit may be required when booking. If you are booking through an Online Travel Agent eg Booking.com there is one night’s accommodation taken at the time of booking – this is NON REFUNDABLE. When booking through our own website One Nights Accommodation is required as a deposit, The remaining payment is required at check-in. If you are arriving after Office Hours the full payment will be taken on the morning of arrival and a late code will then be sent. Once payment has been made there are NO Refunds available. Rates that contain restrictions must be paid at the time of making the reservation. Please refer to individual rate terms prior to confirming your reservation.

Payments

A valid credit card MUST be presented at check-in to the Apartment. Payments may be made by credit card, cash or EFTPOS on arrival at the Apartments. If you are arriving outside office hours your card will be charged for the entire amount of your stay either the day before or the day of arrival. An access code for the safe will then be emailed to you with instructions for your late arrival. Once payment has been made there are NO Refunds available. If you are settling your account by credit card, please note that for Visa Card, Mastercard a 1.5% credit card transaction fee will apply. For American Express a 2.5% credit card transaction fee will apply. You agree to pay interim accounts when presented even though you may not have departed from our apartments. You agree that any charges for services to you, not billed at the time of your departure, may be added to your account for settlement as arranged or may be charged to the same credit card used to pay the account at the time of departure or to the credit card used to guarantee payment of your account.

Rates and Charges

You agree that you will pay to us the room rate for each day of your stay and any additional charges up until the time you advise us that you have departed from our apartments. Once payment has been made there are NO Refunds available. All prices are quoted in Australian dollars per room per night and are inclusive of GST. Special event periods/rates may apply.

Cancellation Policy

For any booking that requires payment on check-in to the apartment, booking must be cancelled by 2:00 pm, 72 hours before arrival to avoid cancellation fee. For any booking that requires a 100 percent deposit on booking, this cannot be cancelled and no changes are permitted. Cancellations after this time are subject to a cancellation fee which will be charged to the credit card used to guarantee payment of your account. The cancellation fee is equal to the accommodation fee payable for 1 night of stay. In the case of a no-show (A no-show is when you do not check-in on the night of your booking reservation) the total price of the reservation will be charged. Tariffs are not refundable if your stay is cut short

Check-in

Standard check-in time is 2.00 pm. You agree that we may apply a charge if your required check-in time requires us to keep the room empty on the previous day. You must advise us of any change in the number of persons using the room and agree to pay any additional charges for additional persons not included in the number stated at the time of registration.

Check-out

Check-out time is 10.00 am on the date shown for your departure unless we agree to another time. Departure after that time may incur additional room charge. You must return the key for the room at the time of your departure and agree to pay a charge for replacement of keys you lose or fail to return.

Parking

Car parking is available at $10/vehicle/night. Vehicle registration details must be provided for each vehicle on arrival.

Pets

Pets are allowed on request, subject to availability of pet-friendly rooms. Charges will be applicable at $25/pet/night

Releases and Indemnity

Any monies or other valuables, goods or vehicles that belong to you, brought in or on to the room, grounds or car park remain your responsibility and we are not responsible for their safekeeping. To the extent permitted by law, you agree to release and hold harmless Toowong Villas and its current and former officers, employees and agents against and from all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damage for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your reservation or your stay at Toowong Villas for any reason whatsoever. You agree to indemnify Toowong Villas and its current and former officers, employees and agents for all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including consequential and economic losses, property loss/damage and damage for injury, including personal injury and death) incurred or suffered by Toowong Villas or its current or former officers, employees or agents arising out of, caused by, attributable to or resulting from your reservation or your stay at the relevant Toowong Villas except to the except caused or contributed to by Toowong Villas or its current or former officer’s, employee’s or agent’s negligence. You agree that regardless of your length of stay there is no tenancy or other proprietary rights created under any laws. We grant you a licence to stay in our apartment and we reserve the right to terminate the licence at any time.

You agree we may use your email address to send you information.

General

These terms and conditions are governed by and will be construed in accordance with the laws of the State of Queensldand, Australia. Nothing in these terms and conditions affect any rights you may have and which by law cannot be excluded, including under the Competition and Consumer Act 2010 (Cth) and under State and Territory consumer protection legislation.

Privacy

We adhere to the National Privacy Principle relating to the collection, use and disclosure of personal information. All information collected from you is required either to meet the requirements of the State legislation regarding the maintenance of a guest register, for fire safety reasons, for billing purposes or for any other purpose stated in our Privacy Policy. We will not make this information available to any third party without your prior consent except where required by law or to enforce our collection of amounts owing by you. You must advise us if any details on this registration card are incorrect. All this data will be retained for the minimum length of time to comply with taxation and accounting requirements (usually seven years). Any personal data is accessible only by our authorized personnel. A charge will be levied if a copy of this paper registration card is required after six months from your departure. Copies (other than electronic data) are not available after two years. We will not knowingly permit any misuse of this data.

Special Notice

Toowong VIllas has a strict no party and/or no gathering policy which is enforced at all times. Toowong Villas reserves the right to refuse and/or evict any guest who does not abide by the policy. Your acceptance of Toowong Villas offer of accommodation is on the terms and conditions outlined above.
